Terms of Service

1. Acceptance of Terms
By creating an account or using Pay for Fail ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the Service.
These Terms constitute a legally binding agreement between you and the operator of the Service.
2. Service Operator
Pay for Fail is operated by a sole trader based in Ireland using the trading name "Pay for Fail".

3. Description of the Service
Pay for Fail is a productivity and accountability platform that allows users to voluntarily pledge a monetary stake against personal commitments.
Users may create commitments with deadlines and optional financial stakes. If a commitment is marked as completed before the deadline, no charge occurs. If the deadline passes without completion, the pledged stake may be charged.
The Service is designed as a behavioral accountability tool.
The Service does not offer gambling, betting, or games of chance. Outcomes depend entirely on user actions.
4. Eligibility
To use the Service you must:
- be at least 18 years old
- have the legal capacity to enter into contracts in your jurisdiction
- provide accurate account information
5. User Accounts
Users are responsible for maintaining the security of their accounts and login credentials.
You are responsible for all activities that occur under your account.
6. Commitments and Self-Reported Completion
Commitments are created and managed by users.
Completion of commitments is self-reported. When a user marks a commitment as completed, the Service records the user's declaration but does not independently verify whether the task was actually performed.
The effectiveness of the Service therefore relies on user honesty and personal accountability.
7. Stakes and Payment Authorization
When creating a commitment with a financial stake, you authorize the Service to charge the pledged amount to your payment method if the commitment deadline passes without being marked as completed.
This authorization is provided at the time the commitment is created.
8. Commitment Lock
Commitments become locked one hour after creation. After locking, the stake amount and deadline cannot be changed.
9. Missed Commitments
If a commitment deadline passes and the commitment has not been marked as completed, the pledged stake may be charged automatically.
Users are responsible for monitoring their commitments and deadlines.
10. Subscriptions
Some features of the Service may require a paid subscription.
Subscriptions are billed on a recurring basis and automatically renew unless cancelled before the renewal date.
Users may cancel subscriptions at any time through the billing interface.
11. Payment Processing
Payments are processed by third-party payment providers including Stripe Payments Europe Ltd. The Service does not store full payment card details.
12. Refund Policy
Charges triggered by missed commitments are generally non-refundable because they represent voluntary pledges created by the user.
Refunds may be issued in cases of technical malfunction or billing errors.
13. Responsible Use
Users should only set commitment stakes they are comfortable losing.
The Service is intended as a productivity and accountability tool and should not be used for financial speculation or risk-taking.
14. Prohibited Activities
Users must not:
- attempt to abuse the payment system
- use stolen payment methods
- attempt to disrupt the Service
- engage in fraudulent or unlawful behavior
Accounts may be suspended or terminated for violations.
15. Limitation of Liability
The Service is provided "as is" without warranties of any kind.
To the maximum extent permitted by law, the operator of the Service shall not be liable for indirect or consequential damages arising from the use of the Service.
16. Account Termination
We may suspend or terminate accounts that violate these Terms or threaten the security of the Service.
Users may stop using the Service at any time.
17. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Ireland.
18. Changes to These Terms
These Terms may be updated from time to time. Updated versions will be published on the website.
